The uMkhonto weSizwe (MK) Party has launched an urgent application in the North Gauteng High Court, seeking to overturn three key decisions made by President Cyril Ramaphosa regarding the Police Ministry.
This legal action follows the Constitutional Court’s recent refusal to hear the matter, directing the party to a lower court.
The MK Party, with former President Jacob Zuma submitting a supporting affidavit, is challenging President Ramaphosa’s decision to place Police Minister Senzo Mchunu on a leave of absence, the subsequent appointment of Professor Firoz Cachalia as Acting Minister, and the establishment of the Madlanga Commission of Inquiry.
According to Zuma’s affidavit, the leave of absence manoeuvre is unprecedented, arguing that it is fiscally irresponsible to pay two ministers for the same portfolio.
The party contends that Ramaphosa’s actions are unconstitutional and should be reviewed and set aside.
The Constitutional Court had previously denied the MK Party direct access to its court in July, ruling that the matter did not fall within its exclusive jurisdiction and should first be heard by a High Court.
