The Zimbabwe Human Rights Commission (ZHRC) has raised concerns over apparent disparities in the treatment of Zimbabwean citizens and foreign nationals within the justice system, particularly in drug-related offenses.
This comes after a recent case involving a Zimbabwean woman, Wadzanai Siyamachira, and a group of ten Chinese nationals who were sentenced differently for similar offenses.
Wadzanai Siyamachira, 38, was sentenced to 18 months in prison, with six months suspended, for unlawful possession of 3.0138 grams of cocaine valued at approximately US$340.
In contrast, ten Chinese nationals found with cocaine, methamphetamine, and other substances worth over US$1,000 were granted bail after one night in custody and fined US$150 with an option of a six-month prison sentence.
The ZHRC has expressed deep concern over the apparent discrepancies in treatment between Zimbabwean citizens and foreign nationals.
“The contrasting outcomes in these cases highlight a troubling double standard,” the ZHRC said.
The commission believes that such disparities undermine the principle of equality before the law and erode public trust in the justice system.
The ZHRC has called for an immediate review of the treatment of drug-related offenses to ensure that all individuals, regardless of nationality, are held to the same legal standards.
“It is imperative that the ZHRC recommends the authorities to investigate the causes of such disparities in order to restore faith in the justice delivery processes,” the commission stated.
The National Prosecuting Authority of Zimbabwe (NPAZ) has pledged to pursue tougher sentences in drug-related cases following public backlash over the sentencing of the Chinese nationals.
The NPAZ stated that all public prosecutors have been instructed to bring appropriate charges and aggressively pursue stiffer sentences that reflect the seriousness of such offenses.
Section 56 of the Constitution of Zimbabwe provides for equality and non-discrimination, affirming that all persons are equal before the law and entitled to equal protection and benefit of the law.
The ZHRC’s concerns highlight the need for the justice system to prioritize equality and fairness in its application of the law.
The ZHRC’s call for reform aims to promote transparency, equality, and fairness within the justice system and ensure that all individuals are treated equally, regardless of their nationality.
